Official Rules: Mobile May Gold Giveaway
ELIGIBILITY. The Mobile May Gold Giveaway (“Sweepstakes”) is open only to legal residents of the United States who are 21 years of age or older at time of entry (individually, “Entrant”). Employees of Provident Precious Metals, LLC, its subsidiaries, affiliates, and parent companies, as well as the immediate family and household members of each such employee are not eligible. All U.S. federal, state and local laws and regulations apply. Void where prohibited by law.
SPONSOR. The Sweepstakes is sponsored by Provident Precious Metals, LLC, 15850 Dallas Parkway, Dallas, TX 75248.
AGREEMENT TO OFFICIAL RULES. Participation in the Sweepstakes constitutes Entrant’s full and unconditional agreement to and acceptance of these Official Rules.
SWEEPSTAKES DURATION AND ENTRY DEADLINES. The entry time is from 5:00 p.m. CST on May 19, 2014 until 11:59 p.m. CST on May 31, 2014. Entries received electronically or postmarked after the May 31, 2014 deadline will be disqualified.
ENTRY INSTRUCTIONS. To be automatically entered into the Sweepstakes, Entrant may use his or her smartphone to make a purchase at ProvidentMetals.com. To be manually entered into the Sweepstakes, Entrant must mail a self-addressed stamped envelope requesting entry to Provident Metals, Mobile May Giveaway, 15850 Dallas Parkway, Dallas, TX 75248. All mailed entries must be postmarked by May 31, 2014 to qualify. Entrants are limited to one (1) entry per day.
PRIZE. The prize is one Provident Metals 1 oz. gold bar with an approximate retail value of $1300.
ODDS. The approximate odds of winning are 1 in 1500.
SELECTING A WINNER. The winner will be chosen in a random drawing on Monday, June 2, 2014 and will be contacted via e-mail or mail. The winner must contact Provident by phone at (800) 313-3315 and claim the prize within one week or a new winner will be selected and notified.
DISCLAIMER FOR ENTRY ERRORS. Provident is not responsible for technical errors related to computers, servers, internet providers, or telephone or network lines; or lost, late, postage-due, misdirected, illegible, or undeliverable mail.
RELEASE, INDEMNIFICATION, AND LIMITATION ON LIABILITY. By entering, Entrant agrees to RELEASE, DEFEND, INDEMNIFY, AND HOLD HARMLESS each of Provident; its parent companies, subsidiaries, and affiliates; and their respective officers, directors, employees, and agents (together, the “Releasees”), from and against any and all suits, claims, demands, liability, loss, damage, injury, harm, or expense (including reasonable attorney’s fees), whether made in contract, tort, negligence, strict liability, or otherwise, which may occur arising out of or relating to (a) Entrant’s participation in the Sweepstakes, (b) errors in the administration of the Sweepstakes or the processing of entries, or (c) Entrant’s acceptance, possession, or use or misuse of any prize. This release, indemnity, and obligation to defend shall apply even if the indemnified loss is partly attributable to the negligence of a Releasee.
By entering the Sweepstakes, Entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes shall be resolved individually without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes (but in no event attorneys’ fees); and (3) under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
GOVERNING LAW. This Sweepstakes and these Official Rules shall be governed by and construed in accordance with the laws of the State of Texas without regard to principles of conflicts of laws.
ARBITRATION. By entering the Sweepstakes, Entrant agrees that any dispute regarding the interpretation or validity of, or otherwise arising out of this Sweepstakes or the breach thereof, shall be settled by binding arbitration before a single, neutral arbitrator in Dallas, Texas, administered by the American Arbitration Association, and judgment rendered upon the award may be entered in any court having jurisdiction thereof.
CONSTRUCTION. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the right and obligations of the Entrant and Provident in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of Texas. The invalidity or enforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
